These Terms & Conditions govern the use of the services provided by naarisafar.ca,
which acts solely as a Facilitator between independent women tour organizers and clients booking travel services.
By accessing or using our platform, website, or services, both Organizers and Clients agree to be bound by these Terms.
1. Role of the Company
- The Company is not a travel agent, tour operator, or service provider under Indian law.
- The Company only facilitates connections between Organizers and Clients.
- All tour arrangements, itineraries, pricing, inclusions, and execution are the sole responsibility of the Organizer.
- The Company does not hire the Organizers; they operate as independent third-party professionals.
2. Eligibility
- Organizers must be adult women (18+) and legally competent to enter contracts.
- Clients must be 18+ or, if a minor is participating, a parent/guardian must provide full consent.
- Users must provide accurate personal information.
3. Services Provided by the Company
The Company may:
- Get clients for their organization
- Facilitate inquiry, communication, and booking
- Offer secure payment channels
- Provide dispute-resolution assistance (non-binding)
- Provide marketing and promotion for Organizers
The Company does not:
- Provide travel services
- Guarantee any tour quality, safety, or service level
- Assume responsibility for Organizer actions, negligence, or service failure
4. Booking & Payments
- All tour prices, inclusions, and terms are determined solely by the Organizer.
- Clients may be required to make booking amount, advance deposits, or full payment depending on the Organizer’s policy.
- The Company may collect payments as a payment facilitator and transfer them to the Organizer.
- The Company is not responsible for refund delays or disputes arising from Organizer policies.
5. Cancellation & Refund Policy
- Cancellations and refunds are governed exclusively by the Organizer’s rules.
- The Company is not liable for Organizer cancelling a tour, client no-shows, partial participation, or force majeure events.
- The Company may assist in communication but has no obligation to enforce refunds.
6. Organizer Responsibilities
- Provide accurate tour information and pricing
- Obtain required permits, licenses, and insurance (if applicable)
- Ensure safety of participants to reasonable extent
- Comply with laws including consumer protection, GST, and local regulations
- Handle on-ground execution, accommodation, transportation, and activities
- Maintain ethical behavior, non-discrimination, and professional conduct
7. Client Responsibilities
- Review all tour information carefully before booking
- Follow Organizer instructions during the tour
- Disclose medical conditions or special needs (if required)
- Carry necessary travel documents
- Obtain personal insurance (recommended but optional)
- Maintain respectful behavior towards Organizers and other participants
8. Liability Disclaimer
- The Company is not liable for accidents, injuries, or death
- Lost baggage, theft, or damage
- Misconduct or negligence of Organizers or third-party vendors
- Service disruptions due to strikes, weather, political events, pandemics, etc.
Organizers and Clients acknowledge that travel involves inherent risks. To the maximum extent permitted under Indian law, the Company’s liability is limited to the intermediary service fee (if any) collected from the User.
9. User Conduct
- Submit accurate information only
- Do not engage in harassment, abuse, or discrimination
- Do not promote illegal activities
- Do not circumvent the platform for direct bookings to avoid fees
- Do not interfere with platform operations
10. Intellectual Property
- All platform content (text, logos, graphics) is owned by the Company.
- Users may not reproduce or distribute content without written permission.
11. Privacy & Data Protection
- Personal data is collected and processed as per Indian data protection laws.
- User data may be shared with Organizers solely for booking purposes.
- The Company does not sell User data to third parties.
12. Third-Party Links & Services
Tours may involve third-party hotels, transport, adventure operators, etc.
The Company has no control over third-party services and is not responsible for their actions.
13. Dispute Resolution
- The Company may provide mediation but is not obligated to resolve disputes.
- Any legal dispute is to be resolved directly between Organizer and Client.
- For Company-related issues, disputes shall be governed by laws of India, with jurisdiction at Bangalore courts.
14. Modification of Terms
The Company reserves the right to modify these Terms at any time. Continued use of the platform constitutes acceptance of updated Terms.
15. Severability
If any clause is deemed invalid, the remainder of the Terms remain enforceable.
